Se ordena remitir el expediente de la referencia a la Sala de Casación Civil y Agraria de la Corte Suprema de Justicia, para que defina cuál de los dos juzgados involucrados en el conflicto negativo de que se trata es competente para conocer de la tutela incoada por la accionante.
Lo anterior, porque los conflictos de competencia que se susciten, ya sea entre los juzgados o entre estos y los tribunales, en materia de tutela, tanto los positivos como los negativos, deben ser resueltos por el superior jerárquico común a los jueces o tribunales que incurren en ello.
